Outlook Amusements, Inc. (“Outlook,” “we,” “us,” or “our”) values your trust and is committed to the responsible management, use and protection of your information. This Privacy Policy describes the types of personal information Outlook collects from and about you when you visit any website that links to the Privacy Policy, including www.californiapsychics.com, our mobile site, and our applications (collectively, the “Sites”), or utilize our services, including connecting with a psychic (our “Services”), and explains how Outlook may use and disclose such information, as well as your ability to control certain uses of it.
Please take the time to read and understand this Privacy Policy. By accessing our Sites or using our Services, you agree to the collection, use, and disclosure of your personal information as described in this Privacy Policy, as well as our Terms of Use. If you do not agree, please do not use our Sites or Services.
For purposes of this Privacy Policy, “personal information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes “personal data” or similar terms as defined in applicable law.

1. NOTICE AT COLLECTION PERSONAL INFORMATION
We collect the categories of personal information listed below. We generally disclose these categories of personal information for business purposes to our service providers, such as payment processors and account management providers to facilitate our Services and access to the Sites. Some of these categories we “sell” or “share” for “targeted advertising” (as such terms are defined in U.S. law) with business partners and third parties, such as data analytics providers, advertising technology vendors, third-party advertising networks, and social media platforms.
We do not knowingly sell or share personal information about persons under the age of 18. Please click here to opt out of the sale or sharing of your personal information, including for targeted advertising. You may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt-out.

When you use our Sites, we collect different types of personal information from and about you. This personal information includes:
  • Identifiers/biographical information, including name, postal and email address, phone number, online identifiers, Internet Protocol (“IP”) address, identifiers provided via Facebook Login, including Facebook UserID, email, date of birth, and Username (“Facebook Login Data”) and other similar identifiers.

  • Commercial information, such as information about your purchase or use of our Sites or Services, including interactions with a psychic (including your reading history), when you enter a contest, if you subscribe to a service (like our horoscopes), take quizzes, participate in a chat room, or when you've considered one of our products or services.
    • Do we sell or share?: Yes.
  • Online activity, such as limited information about how you use the Internet, including browsing and/or search history related to the sites you visit before or after you visit our Sites, the type of operating system you're using to connect, your interactions with our Sites or our advertisements, your IP address, and other data that identifies your online activity.
    • Do we sell or share?: Yes.
  • Audio, electronic or similar information, including call and chat recordings.
    • Do we sell or share?: No.
  • Inferences, meaning inferences drawn from the above-listed categories of personal information to create a consumer profile reflecting consumer preferences or characteristics.

  • Sensitive personal information, including payment information, information revealing racial or ethnic origin, citizenship or immigration status, sexual orientation, etc.
    • Do we sell or share?: No.

    • Note - We do not use or disclose such sensitive personal information for the purpose of inferring characteristics about you or for any purpose other than the limited permissible business purposes set forth in applicable law. Such purposes include providing our Services and verifying, maintaining the quality of, and improving our Services.
b. Purposes for Processing Your Personal Information
We may process your personal information listed above for the following purposes:
  • Providing our Services
  • Reviewing the usage and maintaining and/or improving the operation of our Site
  • Processing your payments and fulfilling your purchases
  • Maintaining, customizing, and securing your account with us
  • Communicating with you, such as through bots, including to respond to inquiries and request feedback from you, to send you updates about your account and changes to our services, or notify you regarding updates to this Privacy Policy or our Terms of Use

We will retain your information for as long as your account is active or as needed to provide you Services. We will retain and use your information as necessary to address outstanding account balances, comply with our legal obligations, resolve disputes, and enforce our agreements.
2. HOW WE COLLECT PERSONAL INFORMATION
We collect the information described above from different sources, including through (a) information you provide to us; (b) information we automatically collect; (c) information we receive from third parties, such as when you login using Facebook Login; and (d) combining information from different sources.
a. Information You Give Us
If you create an account, make a purchase, fill out a survey, sign up for emails, enter a contest, or provide testimonials, you share your personal information with us. Sometimes, you can choose not to give us information. For example, you don’t have to sign up for emails. But other times, we’ll need your information to be able to provide you with the requested services (e.g., setting up your account).
If you link a social media account through our Sites or Services, we may receive certain information about you based on your registration and privacy settings on those third-party services. This may include, but may not be limited to, name, username, demographic information, updated address or contact information, location, interests, and social media and online activity. For more information on integrations with social media platforms you use, and other third-party sites, please see Section 9 (“Third-Party Content, Links and Plug-Ins”) below.
b. Information Automatically Collected
When you visit our Sites and interact with our Services, we may use technologies such as cookies, web beacons, or similar tracking technologies to automatically or passively collect certain information about visitors to our Sites and interactions with our emails and online advertisements, and to allow Outlook to keep track of analytics and certain statistical information, which enables Outlook to improve its Sites and provide you with more relevant content and advertising on our Sites and other sites. You may have options to change your browser settings to choose how we can collect some of this information.
The specific types of information that we and/or our partners and service providers may collect from you include:
  • Device and browser information. This includes your device's IP address and/or other unique identifiers, browser type, device type, internet service provider, and operating system.
  • Location information. When you access our Sites and Services from a mobile device, your device's approximate location (derived from your device's IP address or other signals) may be collected.
  • Usage information. When you interact with our Sites and Services, certain information may be collected by us or our third party vendors, including the date and time of your visit, the pages you view immediately before and after you access our Sites and Services, the areas or pages of our Sites that you visit, the amount of time you spend viewing or using our Sites or Services, items placed or left in your shopping cart on the Sites, keystrokes, mouse movements, form field entries, recordings of chat sessions or your use of and inputs to other AI-supported tools, and other use and overall engagement with our Sites and Services.
  • Marketing information. If you receive an email from us, information may be collected about your interactions with the message (e.g., whether you opened, forwarded, or clicked through to our Sites).
  • Third-party analytics technologies. We may use third-party analytics tools to better understand who is using our Sites and Services, how people are using them, and how to improve their effectiveness as well as the effectiveness of any related content.
c. Information Collected From Third Parties
We may receive personal information from other sources, including business partners and companies that co-sponsor our promotions, marketing/advertising and analytics partners, such as online advertising networks, social media platforms, and other companies that provide personal information to supplement what we already know about you, including data aggregators.
d. Combination of Information
We may combine the information we receive from and about you, including information you provide to us and information we automatically collect through our Sites and Services, as well as information collected from other online sources or from third-parties (including social networks that you use to connect with Outlook) to help us tailor our communications to you and to improve our Sites and Services. We use, disclose, and protect combined Personal Information as described in this Privacy Policy.
3. HOW WE DISCLOSE THE INFORMATION
We may disclose each category of your personal information to the following categories of recipients:
  • Our affiliates. We may disclose your personal information with our affiliated companies or brands for purposes consistent with this Privacy Policy and other business and operational purposes.
  • Service providers. We may disclose your personal information to service providers who perform services on our behalf. For example, this may include merchandise vendors and payment processors. It may also include companies that send emails on our behalf or help us operate the Sites or provide the Services. Our service providers are restricted in their use of personal information that we disclose to them.
  • Research partners. We may disclose your personal information to our research partners, including those that perform surveys or research projects in partnership with us or on our behalf.
  • Business partners. We may disclose your personal information to other companies with whom we partner to offer products and services and carry out other related activities. We may disclose certain personal information to third-party data providers, including data aggregators and data brokers, who collect personal information about consumers from various sources to create consumer databases that help companies and brands understand consumer behavior, grow their customer relationships, and meet their marketing and advertising objectives.
In certain limited circumstances, we may also disclose your personal information to the following:
  • Relevant third parties in connection with a business transaction or reorganization. In the event we are involved in a corporate business transaction, such as a merger, acquisition, joint venture, financing, or sale of all or a portion of our company assets, personal information that we have collected may be transferred to such entity and its advisors leading up to and/or following the transaction. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, personal information that we hold may be considered an asset of ours and may be sold or transferred to third parties.
  • Competent governmental and public authorities. We may disclose your personal information as legally required pursuant to a court order or subpoena, to cooperate with a government agency or investigatory body request, or to otherwise comply with applicable law.
  • At your direction. We may disclose your personal information to other parties at your direction or with your consent.
  • Other parties. Finally, we disclose your personal information to other parties as we believe necessary or appropriate either to: (i) comply with applicable law; (ii) protect our operations and those of any of our affiliates; (iii) investigate and prevent against fraud; (iv) protect our rights, privacy, safety, or property and/or those of others; or (v) allow us to pursue available remedies or limit damages that we may sustain.
We may disclose your personal information for other reasons that we will describe at the time of information collection or prior to disclosing your information.
We also may de-identify or aggregate personal information so that it will no longer be considered personal information and disclose such information to other parties for purposes consistent with those described in this Privacy Policy.
All of the above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.
4. OUR USE OF COOKIES
As noted above, we (and our partners and service providers) use the following types of cookies to collect your personal information:
  • Strictly necessary cookies. These cookies are essential to enable you to move around the Sites and use their features. These cookies allow us to provide some of the basic functionalities of our Sites.
  • Performance cookies. These cookies generally collect information about how visitors use the Sites so that we can improve our Services. These cookies do not collect identifiable information.
  • Functionality cookies. These cookies allow the Sites to remember the choices you make as you browse the Sites. They provide more enhanced and personal features. The information collected is anonymized, and they cannot track browsing activity on other sites once you leave the Sites.
  • Targeting/advertising cookies. These cookies may be set by our advertising partners, including social media platforms. They may be used by our partners to build a profile of your interests and show you relevant advertisements on other online services, which is known as “interest-based advertising.” These cookies uniquely identify your browser and device and observe your behaviors and browsing activities over time across multiple websites or platforms.

5. YOUR PRIVACY CHOICES
We provide you the ability to make certain choices about how we process your personal information.
a. U.S. State Privacy Rights
Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Texas, Tennessee, Utah, Virginia, or any other state with an applicable privacy law have certain rights relating to the collection, use, disclosure, and other processing of their personal information.   • Right to know. You may have the right to know what personal information we have collected about you, including the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, the categories of personal information disclosed to third parties, and the specific pieces of personal information we have collected about you. You may also have the right to access this personal information in a portable format.
  • Right to request categories of third parties. You may have the right to request a list of the categories of third parties with which we disclose your personal information.
  • Right to request specific list of third parties. You may have the right to request a list of the specific third parties with which we have sold or may sell your personal information.
  • Right to access a list of specific third parties. Rhode Island residents can request a list of all third parties with which we have sold or may sell personal information by sending a request to Privacy@californiapsychics.com.
  • Right to delete. You may have the right to request that we delete personal information that we have collected from or about you, subject to certain exceptions.
  • Right to correct. You may have the right to correct inaccurate personal information that we may maintain about you, subject to appropriate verification. Where appropriate, we may comply with a right to correct by deleting your personal information.
  • Right to opt out of sale and sharing of personal information, and use for targeted advertising. We use and disclose to third parties personal information for analytics and advertising purposes. Accordingly, you may have the right to opt out of the "sale" or "sharing" of your personal information, or the use and disclosure of your personal information for "targeted advertising" (as these terms are defined in applicable law).
To take advantage of your right to opt out of the sale or sharing of personal information or to opt out of targeted advertising, please click on the Do Not Sell or Share My Personal Information link available in our website footer. Alternatively, you may choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control ("GPC"). We will process the GPC signal as a request to opt out. Please note that if you use different browsers or browser profiles, you will have to enable the signal on each one that you use. We will never ask you to verify your identity to exercise your right to opt out of the sale of your personal information.

Right to an authorized agent. In certain states, you may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using a consumer’s personal information, or any information collected from or about the consumer, for any purpose other than to fulfill the consumer’s requests, for verification, or for fraud prevention.
Verification. Consistent with applicable law, please understand that, depending on the type of request you submit, and to protect the confidentiality of yours and others' personal information, we will only complete your request when your identity has been verified. We will seek to match the information in your request to the personal information we maintain about you. As part of our verification process, we may ask you to: submit additional information, use identity verification services to assist, or, if you have set up an account on our website, to sign into your account as part of our identity verification process. Where permitted under applicable law, we may decline a request (other than for opt outs) if we are unable to verify your identity (or an agent’s authority to make the request) and confirm the personal information we maintain relates to you.
Right to appeal. Depending on your U.S. state residency, you may have the right to appeal a decision we have made in connection with your privacy rights request. To appeal a refusal to take action on your request, please see the instructions in our response to your request or submit your appeal in writing by contacting Privacy@californiapsychics.com with the subject “Appeal of Consumer Privacy Rights Request.” If you are unsatisfied with the way that we have handled your appeal, you may have the right to complain to your state’s attorney general.
You are not required to create an account to exercise your state privacy rights.
We will not discriminate against you for exercising your consumer privacy rights outlined in this Section.
b. Google Analytics
Our website uses technology provided by Google to facilitate advertising and reporting. We implement Google Analytics cookies to collect personal information about you when you visit our website for purposes of remarketing, impression reporting, and demographic and interest reporting. This information includes device identifiers, IP address, and browsing history, and can be combined with other data related to you collected through Google’s advertising cookie or other third-party technology. You can opt-out of the use of this technology through the Google Analytics opt-out browser add on, Google Ad Settings, and/or Ad Settings for mobile apps.
c. Marketing and Promotional Communications
Email Marketing: You can view or change your preferences to receive subscriptions (e.g., horoscopes, newsletters), promotional communications, and alerts at any time by accessing the Mail Preferences and My Alerts sections of your member account, or by contacting us at Privacy@californiapsychics.com. You also may choose to stop receiving such communications delivered by e-mail by following the unsubscribe instructions included in the emails. Even if you unsubscribe from certain emails, we may still send you messages regarding transactions you’ve made or other important non-marketing communications.
Text Message Marketing: When you provide your mobile telephone number and opt-in to our text message marketing program (“Messaging Service”), you agree to receive recurring automated promotional marketing text messages from California Psychics, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided. Consent to receive automated marketing text messages is not a condition of any purchase. You may opt-out at any time. Message frequency will vary. Reply STOP to cancel, Reply HELP for help or email support@californiapsychics.com. Message & Data rates may apply. Carriers are not liable for delayed or undelivered messages.
We collect various information on our behalf from and about you, including information you directly provide when you use the Messaging Service. When you send messages via the Messaging Service, we also will collect your messaging history and any information included in those messages. We also may collect information about you using cookies or similar technologies. Cookies are pieces of information that are stored by your browser on the hard drive or memory of your device. Cookies enable personalization of your experience on the Messaging Service. You may opt-out at any time.
d. Facebook Login Data: Right to Delete
You may request that we delete your Facebook Login Data at any time by submitting a request by email to Privacy@californiapsychics.com or by mail to California Psychics, 3746 Foothill Blvd., #1119, Glendale, CA 91214.
6. NOTICE OF FINANCIAL INCENTIVE
We offer financial incentives to promote our products and services. These include:
  • The Karma Rewards Program, which provides members a $20 credit for signing up, allows members to accumulate redeemable points with every purchase and other perks.
  • Points programs, discounts, coupons, and special offers when you sign up for email lists or marketing promotions, or other incentives that we may announce in the future.
As part of these financial incentives, we ask you to provide personal information, including the following categories: first name, last name, date of birth, phone number, and email address. Because these promotions involve the collection of personal information, they may be interpreted as “financial incentive” programs under California law or “bona fide loyalty programs” under Colorado law. We use this information for the purposes described above under the section titled “Notice at Collection of Personal Information,” including for targeted advertising. We may share your Personal Information with third parties as described in our “Notice at Collection of Personal Information,” including data analytics providers, advertising technology vendors, and social media platforms.
Participation in any financial incentive is optional. To enroll in the Karma Rewards Program, please click here. You may withdraw from the program at any time by contacting us at 1-800-230-1300. To stop receiving our coupons or discounts in your email, you may unsubscribe from our emails by clicking the “unsubscribe” button at the bottom of any such email. If you ask us to delete your personal information, we will not be able to provide you with access to these programs.
The value of any financial incentive we offer is reasonably related to the value of any personal information you provide to us. We estimate the value of your personal information by considering, without limitation, the expenses we incur from collecting your personal information and/or providing the financial incentive to you, the revenue generated by your use of the financial incentive, and any improvements we can make to our products and services based on aggregating information obtained through the financial incentive program.

7. ADDITIONAL NOTICE TO EEA AND UK RESIDENTS
For residents of the European Economic Area and United Kingdom, Outlook is the controller responsible for processing your personal data.
Lawful Basis for Processing: Applicable law in certain jurisdictions requires us to set out the “lawful basis” that we rely on to collect and use your personal information. Where applicable, the lawful bases upon which we rely on in order to collect and use your personal information are as follows:
  • Consent. We may collect, use, and disclose your personal information on the basis of the consent that you provide us at the point of information collection or disclosure. You have the right to revoke your consent at any time.
  • Contractual necessity. We may collect and use certain personal information where it is either necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract. This may include personal information used to provide you with our products and related services and related transaction information.
  • Compliance with a legal obligation. We are subject to various legal requirements in the jurisdictions in which we operate, and we may use, disclose, and retain your personal information if necessary for us to comply with a legal obligation arising under an applicable law to which we are subject.
  • Legitimate interests. We may collect and use your personal information to the extent necessary to carry out our legitimate interests (or those of a third party), provided that such interests do not outweigh your interests or fundamental rights and freedoms. For example, we may collect and use your personal information in reliance on a legitimate interest in managing our relationship with you; conducting and managing our business; providing you with customer support; conducting market research; developing and enhancing our Services; detecting and preventing fraud and other harmful activities; and monitoring and maintaining the security of our data, systems, and networks.
Privacy Rights and Requests: Under applicable law, you may have certain rights in relation to your personal information, including:

  • Right to erase. The right to erase personal information pertaining to you, under certain conditions. We will assess any deletion request after verifying your identity and work to respond within one calendar month, and let you know if we need additional time.
  • Right to object. The right to object to our processing your personal information, under certain conditions.
  • Right to restrict. The right to restrict the processing of your personal information, under certain conditions.
  • Right to data portability. The right to receive the data we have collected from you. Under certain conditions, you may request that we transfer your personal information to another organization, or directly to you.
  • Right to lodge a complaint. You have the right to file a complaint with the supervisory authority in your jurisdiction.
At any time, you may request or assert any of the rights above by emailing us at Privacy@Californiapsychics.com. If you believe there has been a violation of your privacy rights, please contact us or the supervisory authority.
You may also have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
8. INTERNATIONAL TRANSFERS
Outlook is a global business and it, or its service providers, may process, transfer, and store information about our users on servers located in a number of countries inside of the EEA, UK, or Canada, or outside of the EEA, UK, or Canada, including in the United States. When you use our Service, your data may be transferred to locations outside your country of residence. In some of these locations, data protection laws may be less stringent than the ones in your home country. To ensure that your personal information is adequately protected, we only transfer your personal information subject to suitable safeguards being in place.
In particular, where we transfer your information outside the EEA or UK and where required by law, we implement an approved data transfer mechanism in place, such as the standard EU Model Clauses. 9. THIRD-PARTY CONTENT, LINKS AND PLUG-INS
Our Sites include links to other websites whose privacy practices may differ from Outlook’s. If you submit personal information to any of those sites, their privacy policies govern your information. We are not responsible for the practices of such sites, and encourage you to carefully read the privacy policy of any website you visit.
The Sites may offer you the ability to interact with social plugins from social media features, such as the Facebook Like and Share buttons, and other widgets and interactive mini-programs that run on our Sites. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Sites. As with linked sites, we have no control over the information that social network plugins collect, store, or use, and we are not responsible for the practices of such sites. In addition, we may receive certain information about you from a third party social network if you choose to link to us or use certain social media features, based on your registration and privacy settings on those third-party services.
10. YOUR COMMUNICATIONS WITH PSYCHICS THROUGH OUR SITES
The psychics on our Sites are independent contractors and Outlook does not directly employ them. We contractually require that the psychics protect the privacy of your personal information consistent with this Privacy Policy and that they not use or disclose your personal information for any purpose other than providing you with the Services you request through the Sites or by phone. You should also take care to protect your personal information and privacy. There is no reason for you to provide any of the psychics on our Sites with personal contact information or specific financial information, including, but not limited to, account numbers or other confidential information related to your identity, and if you do so, Outlook bears no liability for any resulting actions.
11. TESTIMONIALS
We may display personal testimonials of customers on our Sites in addition to ratings and other endorsements. We may post your testimonial along with your name or other personal information with your consent. If you wish to update or delete your testimonial, you can contact us at Privacy@californiapsychics.com. More information on our policy regarding testimonials can be found in our Terms of Use.
12. SECURITY
Outlook is committed to handling your customer information with high standards of information security. We maintain numerous safeguards to guard your personal information.
